4. INTELLECTUAL PROPERTY RIGHTS

GeneGPS asserts sole ownership or licensing rights over all intellectual and industrial property associated with our collaboration with 24 genetics and the content available on the Website. This encompasses trademarks, copyrights, patents, trade secrets, and any other proprietary information. The content presented on the Website, including but not limited to text, graphics, logos, images, audiovisual materials, software, and data compilations, is safeguarded by relevant intellectual property laws and international treaties.

Users are granted a limited, non-transferable, non-exclusive license to access and utilize the Website for personal, non-commercial purposes. This entails viewing, downloading, or printing portions of the content solely for personal use. Any unauthorized reproduction, modification, distribution, or exploitation of the Website's content, in whole or in part, without prior written consent from GeneGPS, is strictly prohibited.

  • You are using the website and services for your own use and you ensure you are aged above 18 years. In navigating, purchasing, or contacting GeneGPS you automatically demonstrate capacity to make decisions about your own health. However if our service if meant for an individual either under the age of 18 or not able to provide capacity then the responsible person for said individuals will have to gain authority by contacting GeneGPS. Failure to do so will mean the contract is made invalid and charges will apply as per the clauses set out in our refund policy. 

  • You also understand that accessing and understanding genetic information is complex and not free from risks. In this sense, you acknowledge and accept these potential risks by signing this Agreement. Below are some of the factors, for illustrative purposes only, that you must examine and agree to before using our services;

    • GENEGPS GENETIC TESTS ARE NOT FOR CLINICAL OR DIAGNOSTIC OR THERAPEUTIC USE. It is important to know that genetics deal with your code but another important factor is epigenetics which acts as a switch that turns your code on and off. Your epigenetics are governed by various modifiable factors such as environment, diet, exposures, etc. We cannot identify spontaneous changes to your genetic code    (mutations) that may or may not be linked with epigenetic/genetic factors. As a result even though a negative test can never guarantee no risk at all from serious medical conditions including cancers, neuro-degenerative conditions, etc, It still offers a risk assessment based on our advanced algorithms and current research applied to your genetic code. Nevertheless, in the event that your physician deems a mutation, DNA predisposition, allergy predisposition, medication alteration, or additional interpretations of the test results to be pertinent, standard procedure is to correlate these clinically and conduct additional investigations as needed. The information in our reports is intended to help the individual better understand their genetic makeup. We do not offer medical advice based on the results of these DNA tests.

    • ERRORS IN ANALYSIS. Our partner labs at 24Genetics follows rigorous quality protocols in the DNA analysis process. They are the leading genetic testing company in Europe and operate with utmost quality. Nevertheless, an extremely small proportion (<0.05%) of the data generated during the process carried out in the external laboratory of 24Genetics can be incorrect or cannot be interpreted. In such a case GeneGPS will act as an intermediary to help either repeat the tests or discuss the difficulty in processing your results. However, GeneGPS will not be held liable for the storage, analysis, reporting of your data. We merely act as the distributor of these services in partnership with our labs 24 genetics.

    • FUTURE RESEARCH. Future scientific research in genetic material can alter the interpretation of your DNA. This may render your current report partially or completely uninterpretable. Our partnership labs will always employ the most advanced algorithm and data sets to your sample ensuring your genetic profile and analysis is most up to date at the time of analysis.

    • SHARING OF GENETIC DATA. You are advised that GeneGPS strongly advises against disclosing your genetic information to unaffiliated parties (such as friends, family, coworkers, etc.). Even if you choose to provide medical professionals access to your genetic information, there is a chance that this information may be included in your medical record and may eventually become available to undesired third parties. In any case, you acknowledge that you will: (i) assume responsibility for the possible consequences derived from sharing access to your genetic data with third parties; and (ii) exonerate GeneGPS and their partnership companies, its employees, managers, directors, contractors, subcontractors, collaborators, successors, authorized representatives and business partners and consider them free from any responsibility derived from (A) The utilisation or dissemination of any data that you submit or that GeneGPS receives as a result of a service request; and (B) The transfer or use of your genetic information or other personally identifiable data that you supply to third parties, whether knowingly or unknowingly, or to third parties for medical diagnosis or other purposes.

  • UNEXPECTED INFORMATION. You will almost certainly discover genetic information about yourself that you were not prepared for. Said genetic information may cause emotional distress in specific circumstances and in rare instances, may even change a person's life. In particular, you may learn facts about yourself that cause you concern. On agreeing to continue with our service you have acknowledged this risk and will not hold GeneGPS or any of its partners liable once the results have been shared with you. You may choose to withdraw this Agreement by following the steps outlined in our returns policy, but doing so does not release you from the financial responsibilities you agreed to when you hired GeneGPS to provide the services.
  • Users are solely accountable for their interactions and activities on the Website and any content they contribute. GeneGPS reserves the right to monitor user conduct and content and take appropriate action against any violation of these terms, including suspension or termination of access.

6. LIABILITY AND WARRANTIES

While GeneGPS endeavors to provide accurate and reliable content on the Website, we acknowledge the inherent risks associated with online platforms. Therefore, GeneGPS cannot guarantee the absolute accuracy, reliability, or timeliness of all content available on the Website.
